These Terms of Service ("Terms") govern your use of GrowthFocusTech.com's AI-powered growth agency services. By completing payment and accessing our client portal, you agree to these terms. If you do not agree, do not proceed with payment.

1. Scope of Services

GrowthFocusTech.com provides AI-executed business growth services, including lead generation, content creation, outreach automation, and performance reporting. The specific deliverables depend on your selected service tier:

Services are AI-executed using automated tools and workflows. Human review occurs on a weekly cadence as part of our documented reporting process.

2. Payment Terms

All fees are billed on a recurring monthly basis unless a one-time project agreement is signed. Payments are processed via PayPal or the payment method specified at checkout.

• Fees are due in advance of service delivery.
• All fees are non-refundable after 7 days from the billing date.
• Late payments beyond 14 days may result in service suspension. We will attempt to contact you before suspending.
• Price changes require 30 days' written notice.

3. Service Delivery

We deliver services through a combination of AI automation and human oversight. Our standard process:

• Week 1: Infrastructure setup — accounts, systems, and initial strategy
• Ongoing: AI-executed campaigns, content creation, and outreach
• Weekly: Documented progress report sent to your client portal
• Monthly: Performance review with recommended optimizations

Delivery timelines are estimates. Actual results depend on market conditions, industry factors, and the quality of information you provide during intake.

4. Cancellation Policy

You may cancel your subscription at any time by providing written notice (email to support@growthfocustech.com). Cancellations take effect at the end of the current billing cycle.

• No refunds for partial months.
• All deliverables produced during your active billing period remain yours.
• We will provide a final handoff report within 5 business days of your cancellation date.
• Accounts cancelled due to non-payment are not eligible for service recovery without full payment of outstanding balances.

5. Intellectual Property

Upon full payment, you own all content, strategies, and deliverables produced specifically for your account. This includes:

• Custom content (copy, emails, ad creative)
• Strategy documents and recommendations
• Campaign plans and execution records

GrowthFocusTech.com retains ownership of:

• General frameworks, methodologies, and tools used across multiple clients
• Pre-existing templates and automated workflows
• AI models and proprietary systems

6. Confidentiality

We treat your business information as confidential. We will not share your business details, strategies, or performance data with third parties. This does not apply to information that is publicly available or already known to us through other means.

We may reference general engagement (e.g., "GrowthFocusTech helped [industry] businesses grow" in aggregate) without identifying specific clients unless you provide written permission.

7. Limitation of Liability

GrowthFocusTech.com provides growth services as-is. We do not guarantee specific revenue outcomes, lead counts, or business results. Our liability is limited to fees paid in the 30 days prior to the event giving rise to the claim.

We are not liable for:

• Third-party platform changes, outages, or policy changes (e.g., LinkedIn, Facebook, Google algorithm updates)
• Results affected by changes in your industry or competitive landscape
• Acts of God, technical failures, or events outside our control
• Performance of channels you choose to exclude from campaigns

8. Dispute Resolution

Any disputes arising from these Terms will be resolved through good-faith negotiation. If unresolved within 30 days, disputes will be submitted to binding arbitration under the rules of the American Arbitration Association. The arbitration will take place in Austin, Texas. Each party bears its own costs; arbitration fees are split equally unless the arbitrator decides otherwise.

These Terms are governed by the laws of the State of Texas. If any provision is found unenforceable, the remainder of the Terms remain in effect.
